Rental Contract

Rental terms:
“studio” is Kalamazoo Creative Studio LLC
“renter” is the person or entity renting the studio and all associates accompanying renter


Photographers, videographers, creatives, business owners, etc. are eligible for booking the studio. Clients may NOT book the studio.

PAYMENT SCHEDULE:
Payment for rental period is due in full at time of booking.

BOOKING PROCESS:
This contract must be complete and you must pay in full in order to complete your reservation.

CANCELLATION POLICY:
A confirmed booking that is cancelled more than 24 hours prior to the booking date and time will incur no charges and may be rescheduled. All payments will be refunded in full if cancelled. Cancellations made less than 24 hours prior to the booking date and time will be charged the full fee of the studio rental period.

For rentals that are 4 or more hours, you may be fully refunded if it is more than 48 hours prior to the rental period. If less than 48 hours, cancellations are non-refundable.

If Kalamazoo Creative Studio LLC must cancel renter’s reservation for any unforeseen circumstances, Renter will be given either rescheduling priority or a full refund at studio owners discretion. Kalamazoo Creative Studio LLC is not liable for acts out of its control, such as building equipment failures, power outages, weather, Acts of God or emergencies. In such cases, Kalamazoo Creative Studio LLC will refund the payment in full.

LENGTH OF USE:
Rental periods are pre-arranged at the time of booking and will be on the website calendars of availability. Renter’s rental time begins promptly at the designated starting time and ends promptly at the designated ending time. Rental time includes set up, tear down, and clean up. For your convenience, rentals are now a minimum of an hour and a half to ensure time for clean up. Studio must be cleaned and vacated by the end of the rental period. No prior drop-off and/or pick-up after completion of shoot, of equipment, props, etc. unless agreed upon by studio owner and renter ahead of time, subject to studio availability. Rentals may be booked back to back, and you will be automatically charged accordingly if you interfere with someone else's rental period. If you arrive earlier than 10 minutes, or stay later than 10 minutes, or interfere with someone else's time, you will be automatically charged $25 for every 10 minutes of extra time or interfered time.

If you need additional time, you must first contact me to see if the studio is available before/after your rental period. If approved, you will be charged accordingly. Charges are $25/30 minutes, or the cost of a full hour.

Studio hours:
Monday-Sunday: 8:00am-8:00pm
Jerico community hours: Monday-Friday 9:00am-6:00pm (if you access to the studio outside of these hours, you must lock the exterior door behind you!)

CONDUCT:
This is a shared studio and we maintain a professional and respectful environment. Renter shall be solely responsible for the conduct, noise, and welfare of all persons accompanying renter while on studio's premises. Renter agrees that a Kalamazoo Creative Studio LLC representative may, at Kalamazoo Creative Studio's LLC sole discretion, be present at any time.

Communication and honesty go a long way with me!

If the representative observes or otherwise becomes aware of dangerous, pornographic, illegal or negligent practices or activities, the representative reserves the right to stop the shoot and may require renter and renter’s party to leave immediately. In this event, no refund will be given for unused time. However, Kalamazoo Creative Studio LLC and its representatives assume no responsibility to act in such cases.

CLEANLINESS:
It is your responsibility to clean up after yourself and your clients. The studio must be left better than when you arrived. Please be sure to thoroughly check all spaces in the studio and clean where necessary - even if you didn't use something or make a mess directly - if you see something that can be cleaned, please clean it. Cleaning procedures include sweeping, vacuuming, wiping down walls, stripping the bed, wiping down tables and mirror, dressing room, etc. cleaning supplies are in the dressing room and supply closet for your convenience.

DAMAGES:
Renter shall be solely responsible for any damages to Kalamazoo Creative Studio LLC property or equipment that occurs on the premises during the rental period. Renter agrees to pay reasonable additional repair costs to bring damaged equipment back to working condition or will cover the cost of what items cost brand new. Renter agrees to pay for damage to the premises including spills, excessive wear, marks, stains, or tears on furniture, walls, ceilings, fixtures or painted surfaces. Renter will be automatically charged for any fees and damages.

*When you arrive, if anything about the space if left dirty, a mess, broken/damaged, out of place, etc. it is your responsibility to take necessary photos/videos immediately upon arrival and notify Camille*

MISC:
Renter must not share keys or lock access codes with anyone, including clients.

Studio is located on the 2nd floor. There is NO elevator access. Bathroom is located downstairs and available for use (directly across from stairs). There is a coffee shop located within the community. Free parking is available on-site.

Please note: if before 8:00am, or after 8:00pm, I may not be immediately accessible. Text messages and calls in the middle of the night will not be responded to until the following morning. 

If it is an emergency, please call 911 always and notify Camille after you have called 911.

FEES:
Cleaning fee: "mess" is subject to studio owners discretion: minimum $75/hr
Smoking fee: $250
Pet cleaning fee: minimum $75/hr
Lights left on: $25
Heat or A/C left on/not set to instructions: $40
Door(s) left unlocked, keys not returned, or lost keys: $100
Violation of any rules: $50
Failure to send exit photos: $10
Excessive background paper use: $10
ANY damage to furniture, equipment, studio structure, etc.: price varies - cost of repairs or cost of new item to replace broken/damaged item

Any fees incurred associated with your rental period may be automatically charged to your card on file. If charges do not go through, additional fees may apply over time. Payment terms will be invoiced and billed accordingly. Failure to pay fees after 3 attempts of reaching out will result in permanent loss of studio use and is subject to legal action.


STUDIO RULES:

• Make art, get creative, have fun, and enjoy the space!! Please respect the space and items provided. This is a very old and fragile building, so please treat it with care and help us to preserve its ole beauty so this space can continued to be shared with others.

• Please keep studio door closed during your rental period. If you leave temporarily, please lock door behind you and take keys with you. The toggle on the inside of the door must be horizontal to auto lock behind you.

• You MUST clean the studio before you leave, even if you didn't necessarily make the mess. If you see something, please quickly clean it or tidy it. up. See "cleanliness" clause above for cleaning procedures that are expected.

• You may not use any other areas within the building for shooting. This is a shared, public community. No storing anything outside of the studio or gathering outside of the studio. You may shoot outdoors on the property as long as you do not interfere with any other businesses and remain respectful of your surroundings. Please stay on gravel pathways.

• Paper backdrops: please use minimum amount necessary and be mindful of your usage. If paper got obviously dirty/ripped, please cut off the end and take to dumpster. Excessive use of paper will be charged accordingly.

• NO shoes on any furniture or rugs. NO SHOES on walls!!!

• Do not put furniture or other items/props directly against the walls. The walls (especially the black wall) scuffs up very easily! Please be conscious of your clients leaning against the walls (belt buckles, zippers, buttons, etc. can easily scratch/dent the wall)

• You may not attach anything to the walls, ceiling, or floor. No thumbtacks, tape, nails, glue, etc. ONLY command hooks may be used but must come off carefully and leave no marks. Any damage left from this will be billed accordingly for labor and cost of supplies.

• No liquid substances are allowed. Any spills/stains/damage to the wood floors will be billed accordingly. NOTE: the floors are old, unfinished hardwood floors. Things includes things like champagne pops/sprays, milk baths, hot cocoa sessions, etc.

• No smoking, vaping, alcohol, illegal drugs, illegal activity or weapons are allowed on the premises.

• No pornographic or sexual activity is permitted.

• Please keep noise level to a minimum. This is a shared space with many businesses, and it is an old building with little insulation and noise travels easily throughout. Please be mindful and respectful if there is an event going on or a yoga class in session below the studio. The yoga studio has meditation classes every Saturday morning from 9:00-10:00 am and Sunday morning from 10:30-11:30 am. If you plan to book during these times, please try to keep noise levels to a minimum (voices/yelling, movement, kids running around, music, etc.) The building managers or tenants might ask to keep the noise down if they feel it's too distracting for those working below.

• If duvet cover is dirty, please strip bed. Do not use the comforter with no duvet cover on. You MUST use a duvet cover.

• Cake smashes must be done on a paper backdrop, or you must bring in your own towel, blanket, plastic cover, sheet, etc. Cake smashes are not allowed to be done on the hardwood floor with no protective barrier.

• Please remove outdoor shoes upon entering the studio. A shoe mat is provided. Please wipe off any dirty pet paws or dirty feet before entering the studio. Cleaning wipes are available.

• Candles may be used for props but may NOT be lit. No open flame, fire or spark of any kind is allowed anywhere on the premises (sparklers, lit candles, smoke bombs, etc.).

• No more than 29 people may be in the studio at once. This is very strict due to city fire code.

• Confetti is ONLY allowed if they are larger pieces. Small confetti is prohibited and will be billed accordingly if used and unable to clean it all up.

• Do NOT open any windows. These windows are old and delicate. Do not lean against windows. Damage fees will be charged accordingly if windows are forced open, broken, or cracked.

• Dogs and cats (referred to as pets) are welcome, but must be approved by Camille prior to your rental period. Any other type of animal is not allowed unless approved by Camille prior to renting. Renter is responsible for any damages and messes made. Pets are NOT allowed on ANY furniture with the exception of the bed, on top of bedding only (no pets on empty mattress). Please clean up after pets (pet hair, accidents, etc.). Pet cleaning and damage fees will be heavily enforced.

• Any diapers, food or drink related trash items that may spoil must be disposed of in the large dumpster outside. Do not leave these items or any items that may rot, smell, or soil in the studio trash can. If the trash is full, please take the bag to the dumpster and put a new trash bag in the can. Outdoor dumpster is near the north end of the parking lot, near the coffee shop. If the dumpster is locked, the silver key (exterior door key) works on the lock - please lock it back up after use.

• You may use any furniture, props, and equipment provided and move around as needed. Anything in the studio remains the sole property of Kalamazoo Creative Studio and is not to be removed from the studio. PLEASE pick up and lift heavy items - DO NOT drag furniture on the floor as this can lead to permanent damages. Floor sliders are available for heavier furniture for your convenience (located in small storage bin drawer). Furniture, props, decor, etc. must be cleaned after use and returned to their designated places before you leave.

• No jumping or standing on furniture. Please use furniture for its intended use and treat items with care. Please no running or jumping inside of the studio as there is a business directly below the studio.

• When you arrive, if anything is out of place, missing, low on supplies, broken, dirty, if lights are left on, or heat/AC are not where the temperatures should be, please notify Camille immediately.

• You must be cleaned up and out of the studio by the end of your rental period. If past your time, you will be charged accordingly. Studio times include any set up, tear down, and clean up that you may have. Please book extra time if needed.

• Failure to pay any fees incurred, misconduct, disrespect, etc. will result in permanent loss of rental privileges at any time.

• Before you leave, please make sure you have done the following and review the instruction sheets posted on the wall inside of the studio:

-empty trash can in outdoor dumpster if full and put new trash bag in
-if bedding was dirtied, please strip bed and place in the dirty laundry basket provided
-return all furniture, props, supplies, etc. back to where they belong (DO NOT DRAG)
-return AC/heat back to the temperature listed on the wall
-notify Camille as soon as possible about anything that needs attention in the studio (something needing to be fixed, supplies restocked, etc.)
-clean up any messes ( cleaning supplies are provided)
-leave the studio better than when you arrived
-send exit photos upon leaving 
-turn off all lights and fan and unplug anything that you plugged in
- if it's cold outside, please open curtains before leaving. If it's warm outside, please close curtains before leaving.
-shut the metal door and main studio door. use key to make sure door is locked!
-return keys to smart lock when finished
-if outside of Jerico business hours (Mon-Fri 9am-6pm), please lock exterior door behind you. You may have to push and turn the lock and fiddle with it a bit - so please make sure it is locked behind you!!! This is very important.

Failure to comply with rules as stated in this contract may result in permanent loss of rental privileges at any time. If you have any future rental times booked, these will be cancelled. You will be fully refunded unless you owe any fees for damages, etc.

LIABILITY:
Kalamazoo Creative Studio LLC rents its facility, including limited equipment, to renter with the understanding that in no event shall Kalamazoo Creative Studio LLC/Camille Saltzman be held liable for ANY damage due to the use of this facility or equipment used by its customers. Renter waives and holds Kalamazoo Creative Studio LLC/Camille Saltzman harmless from any incidents or accidents which may occur to or by persons renting or associated with the renting of the studio on the dates noted, or any additional dates previously added or added later under renters name. Renter understands the use of the studio and equipment is solely at renters risk. The Renter agrees responsibility for any loss (in the amount solely determined by owner) or damage to the studio; equipment on premises of the business resulting from the renter’s same (except for normal wear and tear).

Renter hereby waives rights to seek legal redress for mishaps, accidents, and/or loss while on studio premises. Renter agrees to leave the studio and adjacent grounds in the same condition or better as they were prior to arrival. Renters are solely responsible for any legal infractions renter or members of renter’s party make during rental period, in the studio or elsewhere on the premises. This includes parking tickets, all other violation or citations, and legal action resulting from the conduct of the shoot, taken at any time. Renter agrees to hold harmless Kalamazoo Creative Studio LLC, its agents, representatives, and contractors acting on its behalf for any loss, accident, or injury to Renters self or anyone who accompanies Renter while on the premises.

Renter agrees to be solely responsible for the conduct and welfare of all persons accompanying renter while on the premises. Renter understands that if the Kalamazoo Creative Studio LLC/Camille Saltzman observes dangerous, pornographic, or negligent practices or activities are being engaged in the studio, we reserve the right to stop the shoot and require Renter and Renter’s party to leave immediately and rental privileges will be permanently terminated — however, Kalamazoo Creative Studio LLC/Camille Saltzman assumes no responsibility to act in such cases. Renters are solely responsible for verifying that all models employed during Renter’s rental period are of legal age for the activities they are to be engaged in. Kalamazoo Creative Studio LLC/Camille Saltzman has no responsibility to determine or verify the age of participants in the renter’s activities but reserves the right to end those activities if it becomes aware that legal age violations are on-going.

INSURANCE:
You must be able to show proof of insurance upon request. Once this contract is electronically signed, Kalamazoo Creative Studio LLC/Camille Saltzman are relieved of all responsibility for unforeseen circumstances (i.e., fire, mechanical building breakdowns, injury). At all times while using Kalamazoo Creative Studio LLC, Renter must carry and maintain, at renter’s sole cost and expense, a commercial general liability insurance policy of no less than $1,000,000 including, without limitation, premises-operations, personal injury and contractual liability. Should the unexpected occur, rental fees, less expenses, will be fully refunded. Kalamazoo Creative Studio LLC/Camille Saltzman as an individual assumes NO responsibility or liability financial or otherwise. If you cannot provide proof of insurance upon request, you agree that you will be held liable for any damages, accidents, fees incurred, etc.
